1. Scope & Applicability

These General Terms and Conditions ("Terms") govern all purchases made through the online shop at maisongenkai.ch, operated by Genkai Works Sàrl. By placing an order, the customer agrees to these Terms in their entirety. These Terms apply to all current and future business relationships between the customer and Genkai Works Sàrl, even if not explicitly referenced again.

3. Products & Descriptions

We strive to describe all products as accurately as possible. Our range includes Japanese tea (matcha, hojicha), ceramics, knives, and vintage crafts. Product images are for illustrative purposes and may vary slightly from the actual item, particularly for handcrafted goods. Food products such as tea come with specific storage recommendations indicated on the packaging. Customers are advised to follow these instructions to ensure optimal quality and freshness.

4. Prices & Payment

All prices displayed on maisongenkai.ch are in Swiss Francs (CHF) and include the applicable value-added tax (VAT). Payment is processed securely via credit card through Stripe. Prices are valid at the time the order is placed. Genkai Works Sàrl reserves the right to adjust prices at any time; however, any price changes will not affect orders that have already been confirmed.

5. Order Process

To place an order, the customer selects the desired products and adds them to the shopping cart. After reviewing the cart, the customer proceeds to checkout, enters their shipping and payment details, and submits the order. An automated order confirmation email is sent upon successful placement. This confirmation constitutes acceptance of the order and the formation of a binding contract. Genkai Works Sàrl reserves the right to refuse or cancel any order at its sole discretion, for example in cases of product unavailability, pricing errors, or suspected fraud.

6. Shipping & Delivery

In summary: shipping within Switzerland is free on orders over CHF 60 (otherwise CHF 8.90); shipping to the European Union is available on request — contact us for a quote. The risk of loss or damage to goods transfers to the customer upon delivery. All delivery times indicated are estimates and are not guaranteed. Genkai Works Sàrl shall not be liable for delays caused by carriers or circumstances beyond our control.

7. Right of Withdrawal

Customers have the right to withdraw from their purchase within 14 calendar days from the date of receipt of the goods, without providing a reason. To exercise this right, the customer must notify Genkai Works Sàrl by email at contact@maisongenkai.com. The following conditions apply:

• Items must be returned unused, in their original packaging, and in the same condition as received.
• Food products (such as tea) are excluded from the right of withdrawal if the seal has been broken or the packaging has been opened.
• The customer bears the cost of return shipping unless the return is due to a defect or an error on our part.
• Refunds will be issued within 14 days of Genkai Works Sàrl receiving the returned items, using the same payment method as the original transaction.

8. Warranty & Defects

Warranty claims are governed by Swiss law, in particular Articles 197–210 of the Swiss Code of Obligations (CO/OR). The following provisions apply:

• Any defects must be reported to Genkai Works Sàrl in writing within 7 days of discovery.
• Natural variations in handcrafted items, particularly ceramics, such as minor differences in glaze, color, or shape, are inherent to the nature of these products and do not constitute defects.
• Genkai Works Sàrl will, at its discretion, repair, replace, or refund defective products.

9. Liability

The liability of Genkai Works Sàrl is limited as follows:

• Total liability for any claim shall not exceed the purchase price of the product(s) in question.
• Genkai Works Sàrl shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, data, or use.
• Genkai Works Sàrl shall not be held liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, war, pandemics, strikes, or disruptions in supply chains (force majeure).

10. Intellectual Property

All content on maisongenkai.ch, including but not limited to text, images, graphics, logos, and branding, is the exclusive property of Genkai Works Sàrl and is protected by applicable intellectual property laws. Any reproduction, distribution, or use of this content without the prior written consent of Genkai Works Sàrl is strictly prohibited.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising out of or in connection with these Terms or any purchase made through maisongenkai.ch shall be subject to the exclusive jurisdiction of the courts of Neuchâtel, Switzerland.

13. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

14. Changes to Terms

Genkai Works Sàrl reserves the right to modify these Terms at any time. The current version of the Terms is always available on maisongenkai.ch. Changes take effect upon publication on the website. Continued use of the website after changes have been published constitutes acceptance of the revised Terms.
